These Terms of Service (“Terms”) govern your access to and use of the otpmagiclink.com website, dashboard, and API (collectively, the “Service”). By creating an account or using the Service you agree to these Terms.
1. Accounts
You must provide accurate registration information and keep your credentials secure. You are responsible for all activity that occurs under your account or API keys. Notify us immediately of any unauthorized use.
2. Acceptable use
You agree not to:
- Use the Service to send unsolicited messages, spam, or phishing content.
- Attempt to bypass rate limits, quotas, or authentication controls.
- Reverse-engineer, decompile, or attempt to derive source code from the Service.
- Use the Service to violate any applicable law or the rights of any third party.
- Resell the Service or expose the API to unauthenticated third parties.
3. Fees and billing
Paid plans are billed in advance on a monthly or annual basis and are non-refundable except as required by law. You authorize us to charge your payment method on file for all applicable fees. We may change our pricing with at least 30 days’ notice.
4. Sandbox and free tier
Sandbox projects are provided free of charge for development and testing. We reserve the right to rate-limit, throttle, or suspend sandbox access to protect the Service.
5. Data ownership and privacy
You retain ownership of any data you submit to the Service. You grant us a limited license to process that data solely for the purpose of providing the Service. Our handling of personal data is governed by our Privacy Policy.
6. Service availability
We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance and unforeseen outages may occur. Any service-level commitments will be described in your subscription plan or a separate agreement.
7. Termination
You may terminate your account at any time. We may suspend or terminate your access if you materially breach these Terms, engage in abusive behavior, or fail to pay fees when due. Upon termination we will delete or anonymize your data within 30 days, subject to legal retention requirements.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS WILL NOT EXCEED THE FEES YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
10. Indemnification
You will indemnify and hold us harmless from any claim arising out of your use of the Service in violation of these Terms or applicable law.
11. Changes to the Terms
We may update these Terms from time to time. Material changes will be announced at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles.
